Use of Information
By viewing or using any data provided as part of and as an output of this Demand Load Calculator, you are confirming that you are aware that Scottish and Southern Energy Power Distribution Ltd, Southern Electric Power Distribution plc and/or Scottish Hydro Electric Power Distribution plc (hereinafter together referred to as “SSEPD”) is the owner of the data and that you will not (i) share with or sell the data to any third party, (ii) use the data for any purpose other than assessing likely Demand, or (iii) in any other way make the data available to any other person without the prior agreement of SSEPD. You will indemnify SSEPD against all costs, claims, damages, losses and expenses arising as a result of any failure by you to comply with these requirements.
We have developed the Demand Load Calculator to assist you with connections applications to our networks. They give a general illustration of your demand requirements only and cannot be relied upon to assess the terms of connection for specific premises. Should the results of the Demand Load Calculator be incorrect or inaccurate, SSEPD do not accept liability for any error within the data, or the misinterpretation of the data by you, and without prejudice to the foregoing generality, SSEPD will not be liable for (i) any additional costs required to rectify any capacity shortfall, or (ii) any costs incurred in building an over-engineered network based on an over-estimated capacity.
Nothing in this disclaimer limits or excludes our liability for (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded by applicable law. Subject to the above, we shall not be liable to you in tort (including negligence) or otherwise, arising under or in connection with your use of the Demand Load Calculator for: (a) loss of profits; (b) loss of sales or business; (c) loss of agreements or contracts; (d) loss of anticipated savings; (e) loss of or damage to goodwill; or (f) any indirect or consequential loss.
If any of these provisions should be determined unlawful, invalid or otherwise unenforceable by reason of law then, to the extent and within the jurisdiction which that provision is found to be unlawful, invalid or unenforceable, then that provision shall be deleted and shall not affect the validity and enforceability of the remaining provisions which shall continue to be binding and in force.
Governing Law and Jurisdiction
These terms and conditions and any dispute arising herein shall be governed by and construed in accordance with the laws of either England or Wales or Scotland depending on the country from which access is made, and subject to the exclusive jurisdiction of the English or Scottish Courts, whichever is applicable.
